These Terms of Service ("Terms") govern your access to and use of the website mysolarpotenial.com and all related services provided by My Solar Potential ("we," "our," or "us"). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.

We reserve the right to update these Terms at any time. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

My Solar Potential provides an online solar savings estimation platform that allows homeowners to:

• Estimate potential solar energy savings based on their home address and electricity usage
• View solar irradiance and roof analysis data powered by third-party APIs
• Request quotes from licensed solar installation companies in their area
• Access educational resources about solar energy

Important: My Solar Potential is a lead generation and information platform. We are not a licensed solar installer, contractor, or energy provider. Any solar installation work is performed by independent third-party contractors, not by My Solar Potential.

You must be at least 18 years of age and a legal resident of the United States to use our Service. By using our Service, you represent and warrant that you meet these requirements. If you are using the Service on behalf of a business or organization, you represent that you have the authority to bind that entity to these Terms.

By using our Service, you agree to:

• Provide accurate, current, and complete information when submitting any form or inquiry
• Not use the Service for any unlawful purpose or in violation of any applicable laws
• Not submit false, misleading, or fraudulent information
• Not attempt to gain unauthorized access to any part of the Service or its related systems
• Not use automated tools, bots, or scrapers to access or collect data from the Service
• Not interfere with or disrupt the integrity or performance of the Service
• Not impersonate any person or entity or misrepresent your affiliation with any person or entity

When you submit your information through our solar calculator or any lead form, you understand and agree that:

• Your contact information may be shared with up to four (4) licensed solar installation companies operating in your area
• These solar companies may contact you by phone, email, or text message to discuss your solar inquiry
• My Solar Potential does not guarantee the quality, licensing, or performance of any solar installer we connect you with
• Savings estimates provided by our calculator are estimates only and are not guarantees of actual savings. Actual savings depend on many factors including your roof condition, shading, local utility rates, and the specific system installed
• You are under no obligation to purchase any product or service from any solar company we connect you with

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that: (a) the Service will be uninterrupted or error-free; (b) any information provided through the Service is accurate, complete, or current; (c) the Service is free of viruses or other harmful components; or (d) any solar savings estimates will reflect actual savings you may achieve.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MY SOLAR POTENTIAL AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF (A) ONE HUNDRED DOLLARS ($100) OR (B) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

You agree to indemnify, defend, and hold harmless My Solar Potential and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with: (a) your access to or use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any information you submit through the Service.

All content on the Service, including but not limited to text, graphics, logos, images, software, and data compilations, is the property of My Solar Potential or its content suppliers and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit any content from the Service without our prior written consent.

Our Service uses third-party APIs and services, including Google Solar API and Google Maps, to provide solar irradiance data and address lookup functionality. Your use of these features is also subject to the respective third-party terms of service. We are not responsible for the accuracy or availability of third-party data.

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your information as described in our Privacy Policy.

These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the American Arbitration Association's Consumer Arbitration Rules, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction.

Class Action Waiver: You agree that any arbitration or proceeding shall be limited to the dispute between us individually. You waive any right to participate in a class action lawsuit or class-wide arbitration.

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause or notice, including if we believe you have violated these Terms. Upon termination, all provisions of these Terms that by their nature should survive will survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms will otherwise remain in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and My Solar Potential regarding the Service and supersede all prior agreements.
